First check whether the actual business activities involve the foreign investment negative list, market-access rules or industry licensing. Being outside the negative list does not mean that no approval or qualification is required. Applicable conditions can only be assessed further once the industry, ownership arrangements and intended location are clear. Reference: Negative List for Foreign Investment Access

Q:How do investment funds enter China in compliance with regulations?

First establish whether the funds are capital contributions, shareholder loans, trade payments or another category. Then check registration, account, authenticity evidence and permitted-use requirements with the handling bank. Funds of different types cannot be freely substituted, and personal accounts or fabricated trade backgrounds should not be used to make capital contributions.
